1 Interpretation
In these terms and conditions:
Customer means any person who purchases or agrees to purchase Products from Mathrivala through the Website.
Products means the food products, snacks, sweets, bakery products, Mathri, Namakpara, Kajupara, Cookies, Rusks and other products displayed for sale on the Website.
Order means an order placed by the Customer through the Website for the purchase of Products.
Website means the Mathrivala website and any associated webpages, online ordering facilities or digital services operated by Mathrivala.
Charges means the price payable by the Customer for the Products, including applicable taxes, delivery charges and any other charges displayed at the time of placing an Order.
Delivery Address means the address provided by the Customer for delivery of the Products.
Business Day means a day other than a Saturday, Sunday or public holiday in India.
We, Us or Our means Mathrivala and its authorised representatives.
You or Your means the Customer purchasing Products through the Website.
2 Application of Terms
These Terms & Conditions apply to all Orders placed through the Website. By placing an Order, the Customer confirms that they have read, understood and agreed to these Terms & Conditions.
These Terms & Conditions constitute the agreement between Mathrivala and the Customer in relation to the purchase and delivery of Products.
Mathrivala reserves the right to update or modify these Terms & Conditions from time to time. Any updated Terms & Conditions will be published on the Website and will apply to Orders placed after the updated terms are published.
3 Products and Orders
Mathrivala will make reasonable efforts to ensure that product descriptions, images, prices and other information displayed on the Website are accurate. However, minor variations in appearance, packaging, colour, size or presentation may occur.
Product availability is subject to stock availability. Mathrivala reserves the right to discontinue, replace or modify any Product without prior notice.
An Order placed by the Customer constitutes an offer to purchase the selected Products. Acceptance of the Order will be confirmed by Mathrivala through the Website, email, SMS, WhatsApp or other available communication method.
Mathrivala reserves the right to refuse or cancel an Order where Products are unavailable, payment cannot be verified, incorrect pricing has been displayed, delivery is not possible, or where fraudulent or suspicious activity is detected.
If an Order is cancelled by Mathrivala after payment has been received, the applicable amount paid by the Customer will be refunded through the original payment method or another appropriate method.
4 Product Information
Mathrivala makes reasonable efforts to provide accurate information regarding ingredients, product descriptions, quantities, packaging and other Product details.
Customers should carefully review the product information before placing an Order, particularly where they have food allergies, intolerances or dietary restrictions.
Products may contain or be manufactured in facilities that handle ingredients including nuts, milk, wheat, gluten and other allergens.
Customers are responsible for checking the applicable product information before consuming any Product.
5 Price and Payment Terms
The price payable for each Product will be the price displayed on the Website at the time the Order is placed.
Unless otherwise stated, applicable taxes and delivery charges may be added to the Product price and will be displayed during the checkout process.
The Customer shall make payment using one of the payment methods made available on the Website.
Mathrivala may use third-party payment service providers to process online payments. Payment information may be processed by such providers in accordance with their applicable terms and privacy policies.
An Order will normally be processed only after successful confirmation of payment, unless Cash on Delivery or another payment method is specifically offered.
If a payment is unsuccessful but the Customer's account has been debited, the Customer should contact Mathrivala with the relevant transaction details so that the payment can be verified and processed appropriately.
6 Delivery
Mathrivala will make reasonable efforts to deliver Products to the Delivery Address provided by the Customer during checkout.
Delivery times displayed on the Website are estimates and may vary depending on location, product availability, courier services, weather conditions, public holidays and other circumstances beyond the reasonable control of Mathrivala.
The Customer is responsible for providing a complete and accurate Delivery Address, telephone number and other information required for successful delivery.
If delivery fails because the Customer provides an incorrect or incomplete address, does not receive the delivery, or is unavailable at the Delivery Address, additional delivery charges may apply where re-delivery is possible.
The Customer should inspect the package upon delivery and notify Mathrivala as soon as reasonably possible if the package appears damaged, opened or tampered with.
7 Cancellation of Orders
The Customer may request cancellation of an Order before the Order has been processed or dispatched.
Once an Order has been dispatched, cancellation may not be possible.
Due to the nature of food Products, cancellation requests after preparation, packing or dispatch may not be accepted.
Where cancellation is accepted and payment has already been received, Mathrivala will process the applicable refund in accordance with these Terms & Conditions.
8 Returns, Refunds and Replacements
Due to food safety and hygiene requirements, food Products generally cannot be returned after delivery unless the Product is damaged, defective, incorrect or otherwise supplied in an unsuitable condition.
The Customer should contact Mathrivala as soon as reasonably possible after delivery if they receive an incorrect, damaged or defective Product.
Mathrivala may request photographs, videos, Order details, delivery information or other reasonable evidence to verify the issue.
Where a claim is accepted, Mathrivala may, at its discretion, provide a replacement Product, refund the applicable amount or provide another appropriate resolution.
Refunds, where approved, will generally be processed using the original payment method. The time taken for the refund to appear in the Customer's account may depend on the payment provider or bank.
9 Product Quality and Food Safety
Mathrivala takes reasonable steps to maintain appropriate standards of quality, hygiene, packaging and food safety in relation to its Products.
Customers should store Products according to the instructions provided on the packaging or Website.
Products should be consumed within the applicable best-before or use-by period stated on the packaging.
Mathrivala shall not be responsible for deterioration or damage caused by improper storage, handling, exposure to unsuitable temperatures, misuse or failure to follow product instructions after delivery.
Customers with allergies or specific dietary requirements should review the ingredients and allergen information before consuming any Product.
10 Intellectual Property Rights
All content appearing on the Website, including text, photographs, graphics, logos, product images, designs, trademarks, software and other materials, is owned by or licensed to Mathrivala unless otherwise stated.
The Customer shall not copy, reproduce, modify, distribute, publish, sell, transmit or commercially exploit any Website content without prior written permission from Mathrivala.
The Mathrivala name, logo, branding, product names and associated materials may not be used without prior written permission.
11 Customer Responsibilities
The Customer agrees to provide accurate and complete information when creating an account or placing an Order.
The Customer shall not use the Website for any unlawful, fraudulent or abusive purpose.
The Customer shall not attempt to interfere with the operation or security of the Website or gain unauthorised access to any system, account or data.
The Customer is responsible for maintaining the confidentiality of any account login information associated with their account.
12 Limitation of Liability
Mathrivala will take reasonable care in providing Products and operating the Website. However, Mathrivala shall not be responsible for circumstances beyond its reasonable control.
To the extent permitted by applicable law, Mathrivala shall not be liable for indirect, incidental, special or consequential losses arising from the purchase, use or inability to use the Products or Website.
Mathrivala shall not be responsible for loss or damage arising from incorrect information supplied by the Customer, improper storage or handling of Products, misuse of Products or circumstances beyond Mathrivala's reasonable control.
Nothing in these Terms & Conditions is intended to exclude or limit any liability that cannot lawfully be excluded or limited under applicable law.
13 Website Availability
Mathrivala will make reasonable efforts to keep the Website available and functioning properly.
The Website may occasionally be unavailable because of maintenance, technical problems, system upgrades, internet connectivity issues or circumstances beyond Mathrivala's control.
Mathrivala does not guarantee that the Website will always be available, uninterrupted, secure or error-free.
14 Privacy and Confidentiality
Mathrivala may collect and process Customer information necessary to process Orders, arrange delivery, provide customer support, process payments and improve its services.
Customer information will be handled in accordance with Mathrivala's Privacy Policy and applicable law.
Mathrivala will take reasonable measures to protect Customer information but cannot guarantee absolute security of information transmitted over the internet.
15 Force Majeure
Mathrivala shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control.
Such circumstances may include natural disasters, fire, flood, severe weather, epidemic or pandemic conditions, government restrictions, strikes, transportation disruptions, power failures, internet or telecommunications failures, civil disturbances or other similar events.
Mathrivala will make reasonable efforts to minimise the effects of such events and resume normal services as soon as reasonably practicable.
16 Termination and Suspension
Mathrivala may suspend or terminate a Customer's account or refuse an Order where the Customer violates these Terms & Conditions, engages in fraudulent activity, provides false information or uses the Website unlawfully.
Termination or suspension shall not affect any rights or obligations that have accrued before termination.
17 Third Party Services
The Website may use third-party services including payment gateways, delivery partners, hosting providers, analytics services and other service providers.
Such third-party services may operate under their own terms and privacy policies. Mathrivala shall not be responsible for matters that are solely within the control of such third-party service providers, subject to applicable law.
18 Publicity
Neither the Customer nor Mathrivala shall use the other party's name, trademarks, photographs, business information or other proprietary information for commercial publicity without appropriate permission, except where otherwise permitted by law.
19 Complaints and Dispute Resolution
If the Customer has any complaint or dispute regarding an Order, Product, payment or delivery, the Customer should first contact Mathrivala so that the matter can be reviewed and resolved amicably.
Mathrivala will make reasonable efforts to investigate and resolve genuine customer complaints within a reasonable period.
Nothing in this clause prevents the Customer from exercising any rights available under applicable consumer protection laws.
20 Notices
Any notice or communication relating to an Order or these Terms & Conditions may be provided through email, telephone, SMS, WhatsApp, the Website or other contact details provided by the Customer.
Customers are responsible for ensuring that their contact information remains accurate and up to date.
21 Changes to Terms and Conditions
Mathrivala may update these Terms & Conditions from time to time to reflect changes in its Products, services, business practices or applicable legal requirements.

22 Miscellaneous
No failure or delay by Mathrivala in enforcing any provision of these Terms & Conditions shall constitute a waiver of that provision.
